Sony rips off Mario and Warioware

Baitohel 2000

What cheek! Baitohel 2000 is a Sony First Party1 Wario Ware Clone for the PSP showcased at the Tokyo Game Show which feature a pair of familiar characters. Not so much parody as a low brow rip off2.

Be sure to read Philip Wesley's comments on the legality of the "parody" under Japanese Law.

Whether or not a certain mark is used as a parody would have no legal implication under the Japanese law. That is, irrespective of whether it is a parody or not, if the trademark actually used is viewed as identical to the registered trademark, it would constitute a trademark infringement.

  1. Yep, you read that right. First Party, not Third Party. [back]
  2. Not to mention a not very funny or clever low blow [back]

The only reason we don’t see Mario on any other machine is perhaps the rip would be too blatant, but then again perhaps I’m wrong about that one. […]
